ActivePure Enterprise, LLC (“ActivePure,” “we,” “us,” or “our”) has created this privacy policy (this “Privacy Policy”) because we know that you care about how your information is used and shared. This Privacy Policy will describe the types of information we collect, and how we use or disclose that information. By visiting www.activepure.com, any of our associated websites or mobile apps (collectively, our “Sites,”) or by ordering any of our products or services, you are accepting the practices described in this Privacy Policy. If you do not agree to this Privacy Policy, you must discontinue use of the Sites.

Information ActivePure Collects

The information we learn from customers helps us personalize and continually improve their experience with us. Here are the types of information we gather:

Personal Information

We may collect information that can be used to identify you personally, such as your name, email address, billing and delivery addresses, telephone number, and payment information (together with other such information, “Personal Information.”) Your submission of Personal Information is voluntary, but we may be unable to provide requested information, products, or services if you choose not to provide the relevant Personal Information. For example, you may provide us Personal Information when you: contact us through the “Contact Us” page; sign up to receive special offers & promotions; register for our catalog or an on-line account; submit an order; call or email customer service; or submit an order to us through our Sites, Customer Service over the phone, or online chat.

If you sign up for our Sites using your Facebook or any other social media account, or if you interact with us on any of our social media accounts, we may gather any information that you give to us or that you agreed that Facebook or such other social media company could provide to us. This information may include, without limitation, your first and last name, username, profile picture, product and/or company reviews, unique social media identifier, and access token, and/or e-mail address.

We may also collect commercial information about the products or services considered or purchased and referral services through our “Contact Us” form, other requests for information and in-person communications.

Other Information

Our servers automatically collect technical and other information about your computer hardware and software which does not identify you personally (collectively, “Other Information.”) Other Information can include: your IP address, browser type, domain names, page views, clicks, access times, referring website addresses, geographic location, and other technical information. We collect Other Information in the following ways:

  • Server Logs.
    Our web servers automatically collect certain information from visitors and registered users, such as your IP addresses, browser type and language, referring and exit pages, URLs, date and time, the sections of our Sites you visit, the amount of time spent on particular pages, and information concerning your use of our Sites websites and/or mobile apps. We may also collect information about your mobile device, including universally unique ID (“UUID,”) app type and version (e.g., iOS or Android,) carrier and country location, hardware and processor information (storage, chip speed, camera resolution, NFC enabled, and network type “Wi-Fi, 2G, 3G, 4G.”)
  • From Cookies.
    We may use both session cookies, which expire once you close your web browser, and persistent cookies, which stay on your computer until you delete them and other technologies, to help us collect data and enhance your experience with our Sites. Cookies are small text files a website can use to recognize a repeat visitor to the website. We may use cookies for various purposes including: to authenticate users, personalize your experience, analyze which portions of our Sites are visited most frequently, and measure and optimize advertising and promotional effectiveness including by serving more relevant ads. If you do not want us to deploy cookies in your browser, you can opt-out by setting your browser to reject cookies or notify you when a website tries to install cookies in your browser. If you choose to disable cookies in your browser, you can still use our Sites, although your ability to use some of the features may be affected.
  • Third-Party Analytics.
    We also use third-party analytics services to evaluate your use of our Sites, compile reports on activity, collect demographic data, analyze performance metrics, and collect and evaluate other information relating to your usage of our Sites and the Internet. These third parties use cookies and other technologies to help analyze and provide us data. By accessing and using our Sites, you consent to the processing of data about you by these analytics providers in the manner and for the purposes set out in this Privacy Policy.

Aggregated and Anonymized Information.

“Other Information” also includes Personal Information that we have aggregated or otherwise anonymized such that it no longer can be used to identify you personally. We do this as part of our ongoing efforts to better understand our users, and to operate, maintain, manage, and improve the Sites and our products and services.
Please note that our Sites do not currently respond to “Do Not Track” signals that may be enabled in your browser settings.

Information Collected by or Through Third-Party Companies and Third-Party Interest Based Advertising

We may share Other Information about you with third parties, including but not limited to, advertising companies and our brand partners, for ad distribution and ad optimization (defined as the tailoring, targeting (i.e., behavioral, contextual, and retargeting,) analyzing, managing, reporting, and optimizing of ads. These third parties may use cookies, pixel tags (also called web beacons or clear gifs,) and/or other technologies to collect Other Information for such purposes. Pixel tags enable us and these third-party advertising companies to recognize a browser’s cookie when a browser visits the site on which the pixel tag is located, which helps us learn which advertisement brings a user to a given site. In addition, we may receive Other Information from advertisers, brand partners, and/or their service providers such as advertising identifiers, IP addresses, and post-conversion data. As noted above, if you do not want cookies deployed in your browser, you can-opt out by setting your browser to reject cookies or notify you when a website tries to install a cookie on your browser. How We Use Information

We may use your Personal Information to:

  1. Fulfill the purpose for which you submitted it, such as to respond to your inquiries and other communications, sign you up for mailing lists, catalogs, direct mail advertising or newsletters, or process and fulfill your orders.
  2. To protect the security or integrity of the Sites and our systems and investigate any suspected breaches.
  3. To comply in our reasonable discretion with legal requests and proceedings.
  4. To exercise or enforce our rights under the Terms of Service and this Privacy Policy.
  5. And as otherwise required to comply with any applicable laws, rules, and regulations.

We may use Other Information, which does not identify you personally, in various ways that we deem useful including operating, maintaining, and improving our Sites, products, and services.

How We Share Information

We do not sell your Personal Information to third parties. We may share Personal Information as described below:

  • We employ other companies and individuals to perform functions on our behalf. Examples may include providing technical assistance, customer service, marketing assistance and email subscription management, billing and payment processing, shipping and delivery of products, and administration of our promotional programs and email campaigns. These other companies will have access to your Personal Information only as necessary to perform their functions and to the extent permitted by law.
  • We may share some or all of your Personal Information with any of our parent companies, subsidiaries, joint ventures, or other affiliates.
  • In the event of a corporate sale, merger, reorganization, sale of assets, dissolution, or similar event, the Personal Information may be part of the transferred assets. If so, the successor of our business will be responsible for continuing to treat your Personal Information appropriately.
  • From time to time, we may provide you access to special financing offers and programs related to the purchase of our products and services. These offers and programs may be provided by third-party financing or credit agencies. In connection with such offers and programs, we may share some or all of your Personal Information or Other Information with such financing or credit agencies.
  • We may also disclose Personal Information: (i) when required by law, court order, or other government or law enforcement authority or regulatory agency; or (ii) whenever we believe that disclosing such Personal Information is necessary or advisable, for example, to protect the rights, property, or safety of ActivePure or others.

We may share Other Information, which does not identify you personally, in any manner that we deem useful, including without limitation to place more relevant advertisements, improve the Sites’ search engine optimization, and identify traffic referred by partners.

Your State Based Privacy Rights

Some U.S. state privacy laws require specific disclosures and/ or may provide additional rights. These disclosures and rights are described below:

We may share certain parts of your Personal Information to cooperative databases, which may in turn give third parties access to such Personal Information pursuant to the terms of the applicable database. If you do not wish to have your Personal Information contributed to cooperative databases or otherwise shared for third-party direct marketing purposes, you may opt-out at no charge by contacting us as set forth at the end of this Privacy Policy.

You may have the right to know whether we are processing your personal data and to obtain the personal data in a readable format, to correct inaccuracies in your personal data, taking into account the nature of the data and the purposes for processing the data, to delete personal data provided by or obtained about you and to opt out of processing of personal data for the purposes of targeted advertising, the sale of personal data, or profiling in furtherance of a decision that produced a legal or similarly significant effects concerning you. If you wish to exercise these rights, you may do so at no charge by contacting us as set forth at the end of this Privacy Policy. We do not discriminate against customers who exercise their rights under applicable privacy laws.

We will respond to authenticated consumers’ requests to opt-out or exercise their rights without undue delay, but no later than forty-five (45) days after receiving the request. Within forty-five days we will either provide a substantive response or notify you of an extension (up to an additional forty-five (45) days).

Accessing and Modifying Information and Communication Preferences

If you are a registered user, you may access, remove, review, and/or make changes to certain elements of your Personal Information (such as contact information) by logging in to your account. In addition, you may opt-out of your receipt of marketing and non-transactional communications by clicking on the “unsubscribe” link located on the bottom of any of our marketing emails. We will use commercially reasonable efforts to process such requests in a timely manner. You should be aware, however, that it is not always possible to completely remove or modify information from our subscription databases. You cannot opt-out of receiving transactional emails such as those related to the administration of your user account on the Sites or any orders you have placed or attempted to place.

How We Protect Your Information

We take commercially reasonable steps to protect Personal Information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. Please understand, however, that no security system or online transmission is impenetrable. We cannot guarantee the security of our databases or the databases of the third parties with whom we may share such Personal Information, nor can we guarantee that the Personal Information you supply will not be intercepted while being transmitted over the Internet. Please do not send us emails with any sensitive information.

Important Notices to Non-U.S. Residents

ActivePure is based in the United States, and the Sites and our services are not intended for use beyond the United States. Please be aware that your Personal Information may be transferred to, processed, maintained, and used on computers, servers, and systems located in the United States or elsewhere outside of your state, province, country, or other governmental jurisdiction where the privacy laws may not be as protective as those in your country of origin. If you are located outside the United States and choose to use the Sites, you do so at your own risk.

External Websites

The Sites may contain links to third-party websites (“External Sites.”) ActivePure has no control over the privacy practices or the content of these External Sites. As such, we are not responsible for the content or the privacy policies of these External Sites. You should check the applicable third-party privacy policy and terms of use when visiting any such External Sites.

Children

We do not sell products or services to children under the age of 18 and do not knowingly collect their Personal Information. If we learn that a child under the age of 18 has provided Personal Information to us, we will take reasonable steps to promptly delete that information from our databases to the extent possible.

Changes to This Privacy Policy

This Privacy Policy is effective as of the date stated at the top of this Privacy Policy. We may change this Privacy Policy from time to time. Any such changes will be posted on the Sites. By accessing the Sites and/or ordering our products or services after we make any such changes to this Privacy Policy, you are deemed to have accepted such changes. Please be aware that, to the extent permitted by applicable law, our use of your information is governed by the Privacy Policy in effect at the time we collect such information. We recommend that you review this Privacy Policy and your user settings on a regular basis.
